Charges filed in shooting
A Freestone county man turned himself into the sheriff’s office Friday afternoon after an arrest warrant was issued in connection with a shooting incident earlier in the week.
Booked into jail on a charge of aggravated assault with a deadly weapon was Art Gray, 78. He was released immediately on a $10,000 bond.
Gray is charged in connection with a incident on Monday, April 5, in which Kevin Miller, 57, former son-in-law of Gray, sustained shotgun wounds to a leg and finger.
The shooting occurred about 6:45 p.m. on FCR 192 near Richland-Chambers Reservoir.
Sheriff Ralph Billings reports that a dispute arose over ownership of some heavy equipment, and moving the equipment from a right-of-way to property owned by Tonya Gray, Miller’s former wife.
At the scene were Art and Tonya Gray, Miller and two other persons, the sheriff says.
Allegations are that Miller drove up to the site, exited his vehicle and attempted to disable a bulldozer.
Evidence shows that the 78-year-old shot out a tire on Miller’s vehicle with a 12- gauge shotgun, then shot Miller while he was in the vicinity of the bulldozer, Lt. Thomas Hendrix says.
The 57-year-old was taken by medical helicopter to a Tyler hospital for treatment of his wounds.
Sheriff’s deputies took possession of a shotgun believed used in the incident.
An arrest warrant for Gray was issued late last week by Peace Justice Shirley Mays, precinct four, and the 78-year-old voluntarily reported to the sheriff’s office for arrest and booking on the aggravated assault charge.
Billings reports that Gray was not arrested at the scene because he has several health complications.
Miller and Ms. Gray were divorced in December 2009, more than a year after a divorce petition was filed.
In January, Miller was convicted on felony charges of aggravated assault of Ms. Gray and criminal mischief.
He was sentenced to probated jail terms and has appealed the convictions.
